This Data Processing Addendum (“DPA“) is incorporated by reference into the Terms of Service and any order form (“Agreement“) entered by and between you, the Customer (as defined in the Agreement) (collectively, “you“, “your“, “Customer“), and the Upwind entity executing the Agreement (“Upwind“, “us“, “we“, “our“) to reflect the parties’ agreement with regard to the Processing of Personal Data by Upwind solely on behalf of the Customer. Both parties shall be referred to as the “Parties” and each, a “Party“.
